     SUBJECT: Military Justice -- Operation DESERT SHIELD

     1. This provides information about special aspects of military
     justice for commanders deployed an Operation DESEP.V SHIELD.

     2. Legal Advice. The SJA is located at the Dragon Base
     compound. Current phone numbers are 9-7650-144 and -550. The
     office is available for all legal support and judge advocates
     will visit units as required.

     3. Nonjudicial Punishment.

         a. A commander who imposes nonjudicial punishment must be
     the commander of a designated unit. Senior officers in charge of
     forward elements of a designated unit may not exercise
     nonjudicial punishment authority. If a lengthy period of time is
     anticipated before the unit commander deploys to Saudi Arabia,
     call the SJA to have a provisional forward command designated by
     the Commanding General.

         b. Commanders may not exercise nonjiidicial punishment
     authority over soldiers who are not assigned or formally attached
     to their organization. If a provisional unit is established, the
     senior officer must assume command of it, and have affected
     soldiers assigned to it.

         C. Commanders must use a DA Form 2627 or DA Form 2627-1, as
     appropriate, for nonjudicial punishment. They must also properly
     distribute the original and copies of DA Form 2627.

     4. Courts-Martial. Commanders who consider disposing of
     misconduct by courts-martial must coordinate with the SJA before:

          a.   Preferring any court-martial charges, or

          b.   Imposing any form of restriction related to charges.
