          ANNEX F (Staff Judge Advocate Support) to OPLAN 5-90


          1.  (U) This innex provides guidance in the following arc?@As:

              a.  (U) Military Justice

              b.  (U) War Crimes


              C.  (U) Legal Assistknce

          2. (U) The -stiff proponent for the knnex is the Brigade Judge
          Advocate (JA).


              (U) General Guidance

              a. (U) The Brigade JA is responsible for providing legal
          support to the command on the administration of military justice
          and other essential legal support.

              b. (U) The Triil Defense Service (TDS) will provide defense
          counsel on an irei basis for soldiers who are subject to court-
          martial, non-judicial punishment and other adverse administrative
          action. Commanders may refer soldiers to the nearest TDS lawyer
          +or legal services. TDS lawyers will also provide legal
          -assistance -For soldiers to the Lxtent that it does not interfere
          with TDS duties.

              C. (U) The Trial Judiciary will provide judicial support ks
          needed.


          4. (U) Special Guidance

              a. (U) ucma


                  (1) (U) The Bde Cdr has not withheld authority to
          handle offenses.


                  (2) (U) Jurisdiction for UCMJ actions will follow
          command    ? Units which have been detached from their parent
          unit wilY-Tall under the jurisdiction of the commander of the
          unit to which they are attached.

                  (z7) (U) The Cdr, VI! Corps has withheld authority for
          misconduct cases involving officers, warrant officers, and
          sergeants mijor. Commanders will promptly notify the Bde Cdr of
          such offenses and the ilILgations of such offenses. Commanders
          will investigate or cause to be investigated the offense. The
          report of investigation with a recommendation as to disposition
         will be submitted to the Bde Cdr upon completion of the
          investigation.

                  (4) (U) The Corps SJA must approve pretrial
          confinement.


                  (5) (U) Soldiers will not be released to host nktion
          authorities without the approval of the Corps SJA.
