f. (U) Claims Administration.
(1) (U) The Department of the Air Force has single
service responsibility for claims involving or generated by
units in the AOR. Claims arising from an accident or
incident will be submitted through the chain of command to
the Corps SJA IAW COSCOM policy letter 1-5.
(2) (U) Claims of US personnel and employees
assigned, attached. or otherwise participating will be
submitted and processed in accordance with established
guidance.
(3) (U) A report of any incident Involving non-US
property or persons and any incident which may give rise to a
claim against the USG in excess of $2500.00 will be submitted
immediately through the Corps SJA. The report will Include
facts and circumstances of the incident. name and unit of
personnel involved. and action taken or contemplated.
Commanders will report such incidents immediately to their
servicing judge advocate.
(4) (U)- SJAs should be aware that claims under Chapters 3.
6, and 10, AR 27-20. must be presented within two'years of
accrual. As the current situation in the Middle East is not
a war or armed conflict. no extension of the two year period
from time of accrual is authorized at this time. For
personnel claims, s'oldiers who desire may give their spouses
written authorization to file the claim.
(5) (U) Staff Judge Advocates should be aware that,
for claims under Chapter 11. AR 27-20, claimants must provide
notice of shipment loss of damage within 75 days of delivery
by filing'DD Form 1840R. When claimants do not file the form
within the 75-day notice period. the claims judge advocate
must reduce any award unless 'good cause' exists. If a
loyed away from his duty station to the Middle
East or in support of those operations for all or a
signinicant portion of th 75-day notice period, the claims
Judge advocate may consider the absence 'good cause' and
waive the reduction for inaction.
g. (U) Legal Assistance.
(1) (U) Subordinate SJAs are responsible for
providing legal assistance for personnel in their assigned
and attached units.
(2) (U) Maximum use of inter-service and
inter-command legal assistance assets is encouraged.
