      SUBJECT: Preliminary Guidance on Foreign Jurisdiction -- Operation
                DESERT SHIELD


      1. This provides preliminary guidance    for commanders faced with
      cases in which US forces personnel, military or civilian, become
      involved with host nation police. CENTCOM is working on final
      guidance.

      2. The Status of Forces Agreement (SOFA) with Saudi Arabia provides
      a measure of protection from foreign jurisdiction, but.all personnel
      must understand the SOFA commits US forces to respect host nation
      law. In addition, the influence of Islamic law in Saudi Arabia is
      such that local police and courts may not recognize government-to
      -government agreements when the agreements have the effect of
      violating individual rights under Islamic law, especially in a range
      of more serious offenses- More serious offenses include all forms of
      homicide, rape, and drug offenses.

      3. The enclosure contains guidance for soldiers who are involved in
      vehicle accidents or other incidents under jurisdiction of the host
      nation police.

      4. US Army personnel facing charges in local courts will not be
      removed or transferred (including approval of leave) from the host
      nation, without approval of Commander, XVIII Airborne Corps.
